These Terms of Use ("Terms") govern your access to and use of the website www.jdonovanac.com (the "Site"), owned and operated by J. Donovan AC, LLC ("J. Donovan AC," "we," "us," or "our"), a licensed HVAC contractor (License No. CAC1815340) serving Ponte Vedra Beach, St. Augustine, Jacksonville, Jacksonville Beach, Atlantic Beach, Neptune Beach, and the surrounding St. Johns County area. By accessing or using the Site, or by scheduling or receiving services from J. Donovan AC, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

1. Use of the Site

The Site is provided for informational purposes, to allow visitors to learn about our HVAC services, request estimates, and contact our business. All content on the Site, including logos, photos, and written content, is the property of J. Donovan AC or its licensors and may not be used without our permission. You agree not to:

• Use the Site for any unlawful purpose or in a manner that violates these Terms;

• Copy, scrape, or reproduce Site content without our prior written permission;

• Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems; or

• Impersonate any person or misrepresent your affiliation with J. Donovan AC.

2. Estimates and Pricing

Estimates provided by J. Donovan AC are valid for 30 days from the date issued, unless otherwise stated in writing. Pricing is subject to change until an estimate is formally accepted. If additional repairs or work beyond the scope of an accepted estimate are identified during service, that additional work requires your approval before we proceed and may be billed separately.

3. Service Policies

Service Areas: We provide residential and commercial HVAC services in Ponte Vedra Beach, St. Augustine, Jacksonville, Jacksonville Beach, Atlantic Beach, Neptune Beach, and the surrounding St. Johns County area.

Scheduling: An individual 18 years of age or older must be present at the service location for the duration of the appointment, unless other arrangements have been approved in advance by our office.

Cancellations and Missed Appointments: Same-day cancellations or missed appointments are subject to a non-refundable $50.00 fee.

Emergency Service: Emergency and after-hours service is available and is subject to an additional dispatch fee.

Customer Responsibilities: Customers are responsible for providing safe, clear access to HVAC equipment, securing pets, and ensuring personal belongings do not obstruct the equipment during scheduled service.

4. Maintenance Plans (Preferred Customer Agreements)

J. Donovan AC offers optional annual maintenance membership plans ("Preferred Customer Agreements" or "PCA") for residential and commercial customers, including Quarterly and Bi-Annual service options. Membership benefits, pricing, and included services, such as scheduled maintenance visits, priority scheduling, discounted repair rates, and reduced dispatch fees, are described in the applicable plan materials provided at enrollment and are subject to change. Membership plans are billed annually per system unless otherwise agreed in writing, and enrollment, renewal, and cancellation are subject to the terms provided at the time of sign-up.

5. Payments

We accept cash, check, and debit or credit card payments. Payment is due upon completion of service unless otherwise agreed in writing. A 3% processing fee applies to debit and credit card payments. Returned or dishonored checks are subject to a service charge as permitted under Florida law.

6. HVAC Service and Product Warranties

Manufacturer parts warranties on new residential HVAC systems are typically 5 or 10 years, depending on product registration and other manufacturer requirements. Commercial system parts warranties are typically up to 5 years. Please refer to the applicable manufacturer's warranty documentation for full coverage terms. J. Donovan AC provides a 1-year labor warranty on repairs and new system installations. This warranty does not cover drain lines or refrigerant. Extended labor warranties are available on new systems installed by J. Donovan AC after the first year; contact our office for details.

7. Financing

The Financing page includes a link to apply for financing through independent third-party lenders (currently Wells Fargo). Any financing application, approval, terms, and conditions are determined solely by the applicable lender and are governed by that lender's own agreements, not by these Terms. J. Donovan AC is not a party to, and assumes no responsibility for, any financing arrangement between you and a third-party lender.

8. Intellectual Property

All content on the Site, including text, graphics, logos, photos, and the overall design, is owned by or licensed to J. Donovan AC and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent.

9. Third-Party Links

The Site may contain links to third-party websites, including social media platforms and financing partners, for your convenience. We do not control and are not responsible for the content, accuracy, or practices of any linked third-party site.

10. Disclaimer of Website Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, J. Donovan AC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or our services, or any circumstances beyond our reasonable control, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site or our services shall not exceed the amount you paid to us for the service giving rise to the claim.

You agree to indemnify and hold harmless J. Donovan AC, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in St. Johns County, Florida.

We may revise these Terms at any time by updating this page. Continued use of the Site or our services after any changes constitutes your acceptance of the revised Terms.
